1. Acceptance of Terms

By accessing or using BuoyShare ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

BuoyShare is a peer-to-peer marketplace that connects equipment owners ("Owners") with individuals seeking to rent marine equipment ("Renters"). We facilitate transactions but are not a party to the rental agreement between Owners and Renters.

3. Eligibility

You must meet the following requirements to use our Service:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Comply with all applicable local, state, and federal laws
  • Not be prohibited from using our Service under any applicable law

4. Account Registration

To use certain features, you must register for an account:

  • You are responsible for maintaining the confidentiality of your account
  • You agree to provide accurate, current, and complete information
  • You must notify us immediately of any unauthorized use
  • You are responsible for all activities under your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. Owner Responsibilities

If you list equipment on the Platform, you agree to:

  • Own or have authorization to rent the equipment
  • Provide accurate descriptions, photos, and pricing
  • Maintain equipment in safe, working condition
  • Include all necessary safety equipment
  • Provide proper safety briefings to renters
  • Verify renter qualifications and licenses when required
  • Respond promptly to booking requests and renter inquiries
  • Honor confirmed bookings unless extraordinary circumstances arise

6. Renter Responsibilities

If you rent equipment through the Platform, you agree to:

  • Use equipment only for its intended purpose
  • Operate equipment safely and in compliance with all laws
  • Possess required licenses and certifications
  • Inspect equipment before use and report any issues
  • Return equipment on time and in the same condition
  • Pay all fees, deposits, and charges in full
  • Not sublease or transfer rental rights to others
  • Report any accidents or incidents immediately

7. Payments and Fees

  • Service Fee: BuoyShare charges a service fee for each transaction
  • Payment Processing: All payments are processed through our secure payment partners
  • Refunds: Refunds are subject to our cancellation policy
  • Security Deposits: May be required and are held until rental completion
  • Taxes: Users are responsible for applicable taxes

8. Cancellation Policy

  • Cancellations more than 7 days before rental: Full refund minus service fee
  • Cancellations 3-7 days before rental: 50% refund
  • Cancellations less than 3 days before rental: No refund
  • Owner cancellations may result in penalties or account suspension

9. Insurance and Liability

  • All rentals include mandatory insurance coverage
  • Insurance does not cover intentional damage or policy violations
  • Renters may be liable for damages beyond insurance coverage
  • Users must report incidents within 24 hours

10. Prohibited Activities

You may not:

  • Use equipment for commercial purposes without authorization
  • Operate equipment while under the influence
  • Engage in racing or reckless operation
  • Violate any local, state, or federal laws
  • Provide false information or impersonate others
  • Harass, threaten, or harm other users
  • Attempt to circumvent our payment system
  • Scrape, copy, or misuse Platform content

11. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is owned by BuoyShare or its licensors and protected by intellectual property laws. You may not use, reproduce, or distribute our content without permission.

12. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF EQUIPMENT LISTED. USERS ASSUME ALL RISKS ASSOCIATED WITH RENTALS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUOYSHARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

15. Indemnification

You agree to indemnify and hold harmless BuoyShare from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

16. Dispute Resolution

  • Disputes between users should be resolved directly when possible
  • We provide mediation services for unresolved disputes
  • Disputes with BuoyShare are subject to binding arbitration
  • Arbitration shall take place in Miami, Florida

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use after changes constitutes acceptance.

18. Termination

We may suspend or terminate your account for violations of these Terms, illegal activity, or at our discretion. Upon termination, your right to use the Service ceases immediately.

19. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
